Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of DigiInfoCard operated by ASHAEDGE SOFTWARES PVT LTD. By creating an account, downloading the app, or using any part of the service, you agree to these Terms and our Privacy Policy.

If you use the service on behalf of an organization, you represent that you have authority to bind that organization.

2. The Service

DigiInfoCard provides:

• Digital business card creation, customization, and hosting
• Sharing via QR codes and public URLs
• Contact capture (including OCR and QR scanning)
• Optional premium subscriptions and analytics
• Corporate administration, employee cards, messaging, CRM, and related tools

We may modify, suspend, or discontinue features with reasonable notice where practicable.

3. Eligibility

You must be at least 18 years old and able to form a binding contract. You must provide accurate registration information and keep it updated.

4. Accounts and Security

• You are responsible for safeguarding your credentials.
• Notify us immediately of unauthorized access at support@digiinfocard.com.
• We may suspend accounts that violate these Terms or pose a security risk.
• One person may not maintain multiple accounts to evade restrictions without permission.

5. Acceptable Use

You agree not to:

• Upload unlawful, defamatory, harassing, or infringing content.
• Impersonate others or misrepresent your affiliation.
• Distribute malware, scrape the service abusively, or attempt unauthorized access.
• Use OCR or contact features to harvest data without a lawful basis or consent.
• Spam, phish, or send unsolicited commercial messages via the platform.
• Circumvent payment, plan limits, or OCR usage quotas.
• Reverse engineer the service except where law permits.

We may remove content and terminate accounts for violations.

6. Your Content and Public Cards

• You retain ownership of content you submit.
• You grant us a worldwide, non-exclusive license to host, display, process, and transmit your content solely to operate the service.
• Public cards are visible to anyone with your link; you are responsible for what you publish.
• You warrant you have rights to all content (photos, logos, trademarks) you upload.

7. Subscriptions and Payments

• Paid plans are billed through Razorpay (or other designated processors).
• Fees, billing cycles, and features are shown at purchase.
• Subscriptions may auto-renew unless cancelled per in-app or portal instructions.
• Refunds follow our refund policy: Refunds are processed within 7 business days for eligible claims as per law.
• Taxes may apply based on your location.

Free tiers may include limits (e.g. OCR scans, analytics).

8. Corporate Accounts

• Organization administrators manage member accounts and may set templates and policies.
• Employer terms may supplement these Terms via a separate agreement.
• We are not a party to disputes between you and your employer.

9. Intellectual Property

The DigiInfoCard name, logos, software, templates (unless you own custom designs), and platform UI are our property or our licensors'. You may not copy or resell the platform without written consent.

10. Third-Party Services

Google, Apple, Razorpay, email, and OCR providers are governed by their own terms. Your use of sign-in and payment features constitutes acceptance of those terms.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED SERVICE, OCR ACCURACY, OR THAT SHARED CARDS WILL GENERATE BUSINESS OUTCOMES.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) INR 5,000.

13. Indemnification

You agree to indemnify and hold us harmless from claims arising from your content, misuse of the service, or violation of these Terms or third-party rights.

14. Termination

• You may stop using the service and request account deletion per our Data Deletion Policy.
• We may suspend or terminate access for breach, non-payment, or legal requirement.
• Sections that by nature survive (IP, disclaimers, liability, indemnity) survive termination.

15. Governing Law and Disputes

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Disputes shall be resolved in the courts of Mumbai, Maharashtra through arbitration as specified after legal review.

16. Changes

We may update these Terms. Continued use after the effective date constitutes acceptance. Material changes will be communicated as required.
